The new law that came into effect on February 1st 2023 governs key family matters including marriage, divorce, child custody and most importantly inheritance. The aim is to promote equality between men and women. The new laws are aimed at protecting the rights of non-Muslim residents in the UAE

The most significant change is that a non-Muslim expat can draft their UAE will to leave their assets to beneficiaries of their choice and appoint guardians of their choice. In the absence of a will the assets can be split between the surviving spouse and children and there is no differentiation between males and females.

This is a huge boost against gender inequality which is a very positive step forward.

However as in the past when the debate exists about non-Muslim ex pats registering a Dubai Courts Will or a DIFC Will, despite the significant changes that are now in effect, the fact remains that at the time of probate the executors will have to employ a local lawyer to deal with the courts and the estate. The costs of the local lawyer can typically range from 50k to 100k. So although a DIFC Will may cost a larger sum at the time of registration you can be rest assured that your estate at the time of your death will not be diminished by any further costs.
